COMMUNICATION CONTENT ON SOCIAL NETWORKS

With your permission, FitFlop may use user-generated images, videos or other content posted to social media sites such as Instagram and Twitter (“User-Generated Content”). You may grant FitFlop permission to use User Generated Content by replying to our social media posts with #TeamFitFlop. By providing your permission, you:

  • Agree to grant to FitFlop and its related companies (including subsidiaries and affiliates as well as participating third parties aforesaid) worldwide, royalty-free, non-exclusive, irrevocable rights to use, copy, distribute, modify, abridge, publish and disclose to third parties your User-Generated Content for any purpose in any medium, including including but not limited to advertising and promotional purposes in our information and/or marketing materials and through services provided by third parties;
  • Ensure that you own all copyright and other rights, including but not limited to intellectual property rights and image rights, in and to your User Generated Content;
  • release us from any claims, liability, responsibility or damages arising from the use, copying, distribution, editing, abridgement, publication, disclosure and/or transmission of the Content User-generated content; o waive any claim to royalties and any right to inspect or approve the work; And
  • Confirm you are at least 18 years old.

We will use commercially reasonable practices to provide credit for your content and provide links back to your social media accounts when possible. However, you agree that such credit is not required and that your permission for us to use your content is not contingent on such credit being provided.

Any personal data you provide will be processed in accordance with our Privacy Policy.

In no event shall FitFlop be liable for any third party claims, losses of any nature or damages, including but not limited to direct damages , indirectly or punitively arising from the use of User Generated Content. You agree to fully indemnify, defend and hold us and our officers, directors, employees, agents and suppliers harmless, immediately upon demand, from any and all claims. claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of our use of User Generated Content.
